Terms & Conditions of Hire
MELBOURNE GLASSWARE HIRE
This Agreement contains the complete terms and conditions of use that apply to you in joining, hiring and all other activities you will make with the owner. You agree to be bound by its terms and conditions of use and shall comply thereof. These conditions of hire apply to all hires by the Company to each Customer unless the Customer is otherwise notified in writing.
Amendments to this agreement can be made and effected by us from time to time without specific notice to you. Agreement posted on the Site reflects the latest agreement and you should carefully review the same before you join or hire from us.
1. DEFINITIONS
In these conditions,
a. In Victoria the “Owner” is Melbourne Glassware Hire.
b. The “Hirer or Customer” refers to the person, firm or corporation hiring equipment from the Owner.
c. The “Site” refers to www.melbourneglasswarehire.com.au
d. “MGH” refers to Melbourne Glassware Hire.
e. The “Equipment” means all the equipment and accessories supplied to the Hirer.
2. QUOTATION
Unless otherwise stated in writing the Company's quotation will be valid for a period of up to teen (10) days from date of issue, after which the Customer agrees to and accepts these Terms and Conditions of Hire.
The amount quoted is for one use of the Equipment only for the hire period. The Customer agrees that all charges for hire loss, hire extension, damage and repair will be paid and that all collection fees or any expenses involved in the collection of these charges will be borne by the Customer.
3. CONDITIONS OF HIRE
The Hirer assumes full responsibility for the Equipment from the time of its delivery into the possession of the Hirer until collection by or returned to the Owner. In accepting the Equipment, the Hirer acknowledges that it has duly examined the Equipment and has satisfied itself as required. Should the Hirer alter the delivery requirements during, or after delivery, the Hirer is liable for all extra costs of the Melbourne Glassware Hire employees.
The Hirer undertakes to:
a. Not remove the Hire equipment or any part thereof from the delivery location, situation and/or position of its installation without consent from MGH.
b. Comply with any written or verbal instructions given to the Hirer or accompanying the Equipment.
c. The hirer agrees not to use the equipment at locations or purposes different to the equipment’s general designated purpose and specified suitability.
d. It is strictly forbidden sub-hire any equipment unless authorised by the owner
e. Ensure that all Equipment is returned or is ready for collection by the Owner's driver, in a reasonably clean, dry and properly packaged condition and, easily accessible for collection.
f. The hirer acknowledges responsibility for the equipment and is liable for any damage.
4. PAYMENT & CHARGES
a. The hirer agrees to pay Melbourne Glassware Hire the hire fee and the damage waiver fee specified for the equipment for the hire period including any applicable GST, penalties and other charges relevant to this agreement.
b.The required fees must be paid to Melbourne Glassware Hire prior to the commencement date of the hire period via our site www.melbourneglasswarehire.com.au
c.The Owner has all the discretion to cancel or deny orders.
d.The Owner is not responsible for pricing, typographical, or other errors in any offer by the Site and reserves the right to cancel any orders arising from such errors.
e. Amount quoted and all prices on the site is in Australian dollars (AUD) and is for the noted hiring term only.
f. You agree that all charges for hire loss, hire extension, damage and repair will be paid and that all collection fees, legal fees or any expenses involved in the collection of these charges will be borne by the Hirer.
g. All orders placed require full payment to confirm the booking. We reserve the right to refuse any booking at our discretion.
5. SECURITY BOND
A security bond will be required depending on the amount of the order. The Customer agrees to pay to the Company the hire charges and any other charges, including charges for loss, damage and repairs or any taxes, GST, duties, levies or other charges paid or payable by the Company.
MGH has the right to request and pre-authorise a valid credit card number in the event of loss and/or damage to the hire equipment and/or labour required to carry out the delivery or collection.
MGH reserves the right to pre-authorise the card provided and release the funds after the event and/or deduct from this security bond the value of the equipment in the event of loss, damage and additional costs associated with the booking.
The security bond will be refunded in full within 3 to 10 business days after the collection of items, provided all items are returned in their original condition and no additional charges are incurred
6. ORDERS CANCELLATION POLICY
Cancellation of orders or products may forfeit all booking deposits as follow:
a. Cancellations that are made more than 30+ days from delivery date will receive a refund minus the cancellation fee. If the total order is less than $500 then a 30% cancellation fee will apply from the payment. If the order exceeds $1,000 then a 40% cancellation fee will apply from payment. will receive a refund for the delivery, collection and security bond fees (if applicable).
b. Cancellations that are made between 8-28 days from delivery date will receive a refund minus the cancellation fee. If the total order is less than $500 then a 60% cancellation fee will apply from the payment. If the order exceeds $1,000 then a 70% cancellation fee will apply from payment. will receive a refund for the delivery, collection and security bond fees (if applicable).
c. No refund applies to cancellations made within 7 days from delivery date. will receive a refund for the delivery, collection and security bond fees (if applicable). The cost for hire equipment is considered a cost of lost opportunity and is not refundable.
d. Orders made outside our delivery service area, outside of our terms of service or otherwise agreed to be cancelled by Melbourne Glassware Hire will incur a $20 merchant and credit/debit card fee which will be deducted from the refund total.
7. DELIVERY & COLLECTION
Melbourne Glassware Hire offers both delivery and collection of hired goods. There is a minimum order spend of $150.00 AUD to be eligible for delivery. Delivery and collection costs are included in the minimum spend requirements unless you are outside our delivery area in which case an extra charge will apply.
a.The glassware/equipment shall be returned reasonably clean and dry, but not necessarily rinsed. Store glassware upright in the storage location provided. Failure to abide by this will and/or return of excessively dirty glassware or hire items will result in loss of security bond.
b.The Hirer must allow any Melbourne Glassware Hire representative access to the goods at all reasonable times.
c. The Hirer must provide safe and proper access to and at the event site.
d.The Hirer is liable for all injury, loss or damage suffered by Melbourne Glassware Hire, its employees or agents while at the event site.
e. The Customer is required to ensure all Equipment is packed as it was supplied and is safe for transit, in the original boxes and are placed in one central area, ready for collection. In the event the Equipment is not ready for collection, and additional time is required on site, additional fees will apply.
f. Equipment quoted are for standard delivery is at ground floor street level only. Extra charges on top of the usual delivery charge apply where the delivery of the Equipment is more than 25 metres away from where our vehicle can park. Extra charges also apply for stairs, steep descents and going up levels in buildings. The Customer is responsible for advising via email if the delivery has any of these conditions. Failure to do so will result in extra charges.
g. Please verify the delivery zone prior to ordering. Orders made outside this delivery zone will incur additional delivery charges and dependant on location may be not be accepted and refunded.
8. DAMAGE WAIVER
a. Responsibility for Equipment
The Hirer is responsible for the equipment from the time of delivery until collection by the Owner. The Hirer shall pay for any damage or loss to the equipment, however caused, during this period. A damage waiver fee is payable by the Hirer to cover normal wear and tear; however, this does not apply to the following:
· (1) Damage resulting from overloading, exceeding rated capacity, misuse, abuse, or improper servicing of the equipment.
· (2) Damage due to the mysterious disappearance of the equipment.
· (3) Damage caused by the use or operation of the equipment in violation of the agreement.
· (4) Damage or loss of the equipment from any unknown cause.
· (5) Glasses chipped by the Hirer will be considered damaged and charged accordingly.
· (6) Replacing missing glasses with other items will also be considered damage.
b. Protection of Equipment
The Hirer must ensure the equipment is protected from the elements during delivery, use, storage, or while waiting for pick-up.
c. Liability and Indemnity
The Owner shall not be liable for any loss or damage caused to persons, property, animals, or other items arising from the use of the hired equipment. The Hirer agrees to indemnify the Owner against any claims resulting from such loss or damage.
d. Authority to Sign Agreement
Any person signing the agreement on behalf of the Hirer guarantees that they are authorized to enter into the agreement on behalf of the Hirer. Should the signatory lack this authority, they agree to indemnify the Owner against all resulting losses and costs.
e. Joint Liability
Where the Hirer consists of more than one person, liability under this agreement shall be joint and several.
f. Damage and Purchase Opportunity
In the event of damage to the equipment, the Hirer may have the opportunity to purchase the damaged items.
9. GLASSWARE BREAKAGES, DAMAGE AND REPLACE.
MGH must be notified immediately of any Equipment lost or damaged during the hire period. The Customer indemnifies the Company in respect of all such loss. The Customer must pay on demand to The Company the following amounts:

10. GOODS & SERVICES TAX (GST)
Where applicable the Customer will be charged in accordance with current Federal and State legislation.
11. GOVERNING LAWS AND VENUE
This Contract will be governed and constructed in accordance with the laws of the state of VICTORIA, the parties submit to the jurisdiction of the Courts of that state for determination of any dispute claim or demand arising out of these Terms & Conditions.
12. MISCELLANEOUS
The Company reserves the right to take photos at event locations utilising the MGH's Equipment. Photos are taken with a focus on the Equipment and are selected with due care to exclude recognisable private property and persons. Photos may be used in publications or other media produced, used, or contracted by the owner.
Photos can also be shared or re-shared through social media platforms.
The hirer agrees to ensure that any site specified on the hire agreement, will be clear of all obstructions to allow Melbourne Glassware Hire to erect, install or place the hire equipment safely. These terms and conditions are governed by the Laws of Victoria and the Hirer and the Owner submit to the jurisdiction of the courts of the State.
ACCEPTANCE OF THESE TERMS
By paying an order/booking you are agreeing to the Melbourne Glassware Hire terms and conditions. Amendments to this agreement can be made and effected by us from time to time.
